These Terms of Use ("Terms") are an agreement between you and Cust-O-Fab ("Cust-O-Fab," "we," "us"). They apply to www.custofab.com, COF World, our 3D interactive world at world.custofab.com, and any future sites hosted by Cust-O-Fab (together, the "Sites"). By using the Sites, you agree to these Terms. If you do not agree, please do not use the Sites. Our Privacy Policy explains how we handle your information.

If you use the Sites on behalf of a company, you confirm you are allowed to accept these Terms for that company.

Who can use the Sites

The Sites are intended for businesses, students, and adults. You must be 16 or older to create a COF World account. You may use the Sites only in compliance with these Terms and applicable law, including U.S. export control and sanctions laws.

COF World accounts

You can explore COF World without an account. An account is needed only for the equipment challenge and leaderboard.

• Your email: sign up and sign in with an email address you own. We send a 6-digit code to sign in; there are no passwords.

• Security: keep access to your email account secure, and link only devices you control. You are responsible for activity under your account; tell us right away if you think someone else has accessed it.

• Closing your account: you can delete your account at any time in Menu > Account, or by contacting us.

Display names and the leaderboard

Your display name and challenge results appear on a public leaderboard. Please choose a display name that:

• is not offensive, hateful, or misleading

• does not impersonate anyone or suggest you represent a company you do not

• does not include other people's personal information or your own if you want to keep it private

We may change or remove a display name or leaderboard entry that breaks these rules or remove scores we believe were not earned fairly. Display names cannot be changed after sign-up. Contact us if you need one changed.

Acceptable use

Please do not:

• Copy, extract, or reverse engineer COF World, its 3D models, or other Site content

• Use bots, scrapers, or automated tools to access the Sites, except search engines that follow our robots.txt

• Cheat in the equipment challenge, or manipulate scores or the leaderboard

• Try to break into, overload, or disrupt the Sites, or get around security, rate limits, or access controls

• Submit false quote requests, spam, or information that is not yours

• Upload files with viruses or other harmful code

• Use the Sites to build a competing product or to collect information about other users

Our content and trademarks

The Sites and their content, including text, photos, drawings, 3D models, software, and the design of COF World, belong to Cust-O-Fab or our licensors and are protected by copyright and other laws. We give you a limited, personal, non-transferable permission to view and use the Sites, and to share links and screenshots of them, for evaluating, learning about, or doing business with Cust-O-Fab. Cust-O-Fab, COF, COF World, and our logos are our trademarks. You are not allowed to use them without written permission from an authorized Cust-O-Fab employee.

Feedback and files you send

You keep ownership of drawings, specifications, and other files you send with a quote request. You give us permission to use them to prepare your quote and to communicate with you. We treat them as confidential. If you send us ideas or suggestions about the Sites, we may use them without owing you anything.

Product information is not engineering advice

Product descriptions, capabilities, photos, 3D models, demos, simulations, and other content on the Sites are general information. They are not engineering advice, a design for your application, or a guarantee of performance. Specifications for your equipment are set only in a written quote or contract, and any applicable code compliance, such as ASME or TEMA, is confirmed in that written scope.

COF World demos and simulations

COF World includes interactive demos and simulations, such as product workspaces with sliders and heat-balance readouts, that show how our equipment works in generalized applications. They are for illustration and education only. They use simplified models and example values, and their results are not real-world calculations or predictions.

Do not use demo or simulation results to size, design, select, operate, or buy equipment, or to make safety, performance, energy, or cost decisions. For real numbers for your application, contact us for an engineered quote. To the extent the law allows, Cust-O-Fab is not responsible for decisions made based on demo or simulation results.

Augmented reality (AR)

When you place a product in your space with AR, stay aware of your surroundings and do not use AR while driving, walking near hazards, or in a work area. AR sizes and placement are approximate and are not a substitute for site measurements or a field survey.

Quotes and orders

Submitting a quote request does not create an order or a contract. Quotes, orders, and services are governed by the written quote and Cust-O-Fab's terms and conditions of sale, which take priority over these Terms.

Third-party links and services

The Sites may link to, or use services from, other companies, such as Paycom for job applications and your phone's own AR viewer. We are not responsible for their content or practices, and their own terms and privacy policies apply.

Changes and availability

We may update, change, or stop any part of the Sites, including COF World features, challenges / contests, the leaderboard, and content, at any time. We aim to keep the Sites available but do not promise they will always be online or error-free, or that challenge progress will never be reset.

Suspension and termination

We may suspend or close a COF World account, remove leaderboard entries, or limit access to the Sites if someone breaks these Terms, creates a security risk, or as required by law. You can stop using the Sites or delete your account at any time. Sections that by their nature should continue, such as ownership, disclaimers, and limits on liability, survive after access ends.

Disclaimers

The Sites are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties about the Sites, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This does not affect warranties in a written quote or contract for our products and services.

Limitation of liability

The Sites are provided free of charge. To the fullest extent the law allows, Cust-O-Fab is not liable for any damages of any kind arising from your use of, or inability to use, the Sites, including direct, indirect, incidental, special, consequential, or punitive damages, and lost profits, data, or business. If a court decides that some liability cannot be excluded, our total liability for all claims about the Sites is limited to $1. These limits do not apply to liability that cannot be limited by law, and they do not change the terms of any written quote or contract.

Indemnity

If you use the Sites in breach of these Terms or the law, and that leads to a claim against Cust-O-Fab, you agree to cover our costs and losses from that claim, including attorneys' fees.

Governing law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law rules. Any dispute about the Sites will be brought in the state or federal courts located in Tulsa County, Oklahoma, and you and Cust-O-Fab agree to their jurisdiction.

General

If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms right away, we retain all rights to enforce it at a later date. These Terms, together with the Privacy Policy, are the full agreement about your use of the Sites.

Changes to these Terms

We may update these Terms from time to time and will post the new version here with a new "Last updated" date. For significant changes, we will give notice on the Sites, or by email to COF World account holders, before they take effect. Using the Sites after changes take effect means you accept the updated Terms.
